These Terms of Use (“Terms”) govern your use of the XBrowser application (the “App”) provided by XBrowser International Limited (“we”, “us”). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. The App
XBrowser is a mobile web browser that offers features such as Spaces (separate cookie / login contexts), optional location deny or spoof for browser geolocation APIs, ad and tracker blocking, Shorts Focus, App Lock, auto-clear on exit, downloads, and related browsing tools.
2. License
Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple devices you own or control, as permitted by the App Store Terms of Use. You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works of the App, except to the extent allowed by law.
3. Eligibility
You must be old enough to consent to these Terms under the laws of your country (and at least 13 years old, or the age required in your jurisdiction). If you use the App on behalf of an organization, you represent that you have authority to bind that organization.
4. Your responsibilities
- You are responsible for how you use the App and for the websites and content you access.
- You must comply with applicable laws and with the terms of third-party sites and services you visit.
- You must not use the App to distribute malware, infringe others’ rights, or interfere with networks or services.
- Features that reduce ads, trackers, or Shorts may conflict with some sites’ expectations or terms. You are responsible for your use of those features.
- You are responsible for safeguarding App Lock credentials and any passwords you store in the App.
5. Spaces & location spoofing
Spaces separate cookies and site data on your device. They do not change your IP address or guarantee anonymity. Location spoofing only affects sites that use the browser Geolocation API; it does not alter network-based location. You agree not to use these features for fraud, impersonation, or other unlawful purposes.
6. Best-effort features
Ad/tracker blocking, cosmetic page cleaning, Shorts Focus, YouTube-related filters, background media, and similar tools are provided as-is and on a best-effort basis. Websites change frequently; features may stop working, miss content, or break page layouts. We may update filter lists or disable features when necessary.
7. Third-party services
The App may include links to third-party websites and may use Google Firebase for analytics, crash reporting, and remote configuration. XBrowser does not monetize through in-app advertisements (for example AdMob banners or interstitials). Third-party websites you visit are not controlled by us; ads or trackers on those sites are subject to their own policies and to the App’s optional blocking features.
8. Privacy
Our Privacy Policy explains how local data and third-party SDKs (including Firebase) are used. By using the App, you acknowledge that Policy.
9. Intellectual property
The App, including its name, design, and software, is owned by XBrowser International Limited or its licensors. Third-party trademarks (for example site names shown in navigation directories) belong to their respective owners and do not imply endorsement.
10. Disclaimer of warranties
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the App will be uninterrupted, secure, or error-free, or that blocking/spoofing features will meet your expectations.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, XBrowser AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE APP IN THE TWELVE MONTHS BEFORE THE CLAIM (OR, IF THE APP WAS FREE TO YOU, USD $0).
Some jurisdictions do not allow certain limitations; in those cases, the above limits apply only to the fullest extent permitted.
12. Indemnity
You agree to defend and indemnify XBrowser against claims arising from your misuse of the App, your violation of these Terms, or your violation of any third-party rights or site terms.
13. In-App Purchases & Subscriptions (App Store)
The App may offer optional paid features through Apple’s In-App Purchase system, including auto-renewable subscriptions branded as XBrowser Premium (for example monthly and yearly plans). Premium currently unlocks benefits such as unlimited Spaces and Space Lock; the exact entitlements shown in the App and on the App Store product page control at the time of purchase.
13.1 Payment
- Payment will be charged to your Apple ID account at confirmation of purchase.
- Prices are displayed in the App / App Store for your storefront and may vary by region, currency, and tax.
- We do not process card numbers ourselves; billing is handled by Apple.
13.2 Auto-renewal
- Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
- Your account will be charged for renewal within 24 hours prior to the end of the current period at the then-current rate for your plan.
- If a free trial or introductory offer is available, unused portions are forfeited when you purchase a subscription where applicable under Apple’s rules.
13.3 Manage & cancel
- You can manage or cancel subscriptions in your device Account Settings: Settings → [your name] → Subscriptions (or via the App Store subscriptions page), or from in-app links that open Apple’s subscription management.
- Cancellation takes effect at the end of the current paid (or trial) period; you keep Premium access until then.
- Deleting the App does not cancel your subscription.
13.4 Restore purchases
If you reinstall the App or switch devices signed in with the same Apple ID, use Restore Purchases in the App to re-activate eligible Premium entitlements after Apple verifies your subscription.
13.5 Refunds
Refunds for App Store purchases are handled by Apple under Apple’s refund policies. You may request a refund through reportaproblem.apple.com or Apple Support. We cannot issue App Store refunds directly.
13.6 Changes to subscriptions
We may change subscription prices, plan lengths, or Premium features with notice as required by Apple and applicable law. Price changes for auto-renewable subscriptions follow Apple’s disclosure and consent rules for your region.
14. App Store (Apple)
If you obtained the App from the Apple App Store, you acknowledge that:
- These Terms are between you and XBrowser International Limited, not Apple Inc. (“Apple”).
- Apple has no obligation to furnish any maintenance or support services for the App.
- In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to the maximum extent permitted by applicable law; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
- Apple is not responsible for addressing any claims by you or a third party relating to the App or your possession and/or use of the App, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims arising under consumer protection or similar legislation.
- In the event of a third-party claim that the App or your possession and use of the App infringes that party’s intellectual property rights, Apple will not be responsible for the investigation, defense, settlement, or discharge of any such intellectual property infringement claim.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- You must comply with applicable third-party terms when using the App (for example wireless data agreements).
- Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
Your use of the App Store is also subject to Apple’s Licensed Application End User License Agreement and related App Store terms. If there is a conflict between those Apple terms and these Terms regarding Apple’s rights and obligations, Apple’s terms control for those subjects.
15. Changes & termination
We may modify these Terms or the App, or discontinue features, at any time. Material changes will be reflected by updating the “Last updated” date. Continued use after changes constitutes acceptance. We may suspend or terminate access if you violate these Terms. Ending these Terms does not cancel an active App Store subscription; cancel that subscription with Apple as described above.
16. Governing law
These Terms are governed by the laws of the jurisdiction in which XBrowser is established, without regard to conflict-of-law rules, except where mandatory consumer protections in your country apply. Courts in that jurisdiction will have exclusive venue, except where the law requires otherwise for consumers.
